Any attempt to interfere with the operation of Affiwise is a violation of criminal and civil law. We will pursue remedies against offending individuals or entities.

DATA PROTECTION ADDENDUM
This Data Protection Addendum ("Addendum") is a part of our Terms and Conditions ("Principal Agreement") for Affiwise.
DEFINITIONS
In this Addendum:
Applicable Laws: Refers to European Union or Member State laws related to Personal Data subject to EU Data Protection Laws and any other applicable law regarding Personal Data subject to other Data Protection Laws.
Controller: The entity determining the purposes and means of Personal Data processing.
Data Protection Laws: Includes EU Data Protection Laws and the data protection or privacy laws of any other country.
EU Data Protection Laws: Refers to EU Directive 95/46/EC, as transposed into domestic legislation, and the GDPR.
GDPR: Stands for EU General Data Protection Regulation 2016/679.
COLLECTION AND PROCESSING OF PERSONAL DATA
We commit to:
Comply with all applicable Data Protection Laws in processing Personal Data.
Obtain necessary permissions and consents from data subjects to lawfully allow the collection, processing, and sharing of Personal Data via Affiwise.
Maintain a mechanism for obtaining and recording consent, a publicly available privacy policy, and not provide services to children under eighteen (18).
SECURITY
Implement appropriate technical and organizational measures to ensure the security of Personal Data, considering the nature and risk of processing.
SUBPROCESSING
Authorize the appointment of Subprocessors, ensuring written contracts provide the same level of protection for Personal Data as outlined in this Addendum.
DATA SUBJECT RIGHTS
Assist in responding to requests to exercise Data Subject rights under Data Protection Laws.
PERSONAL DATA BREACH
Promptly inform Data Subjects of any Personal Data Breach and assist in its investigation, mitigation, and remediation.
GENERAL TERMS
Disputes arising under this Addendum are subject to the jurisdiction stipulated in the Principal Agreement.
In case of any provision being invalid or unenforceable, the remainder of the Addendum remains valid.
IN WITNESS WHEREOF, this Addendum is part of the Agreement, effective from the date first set above.
